In situations where the decisions given by the department is unfavorable to the visa applicant or the visa holder, a review can be pursued. An application for the review has to be made to the Migration and Refugee Division (MRD) of the Administrative Appeals Tribunal (AAT).
The review body undertakes the assessment process as if it was a new application. It is genuine second chance for the applicant to present their case and provide new evidence.
There are strict time limits for applying for merits review. It is therefore imperative to consult a migration agent and seek professional advice upon receiving an unfavorable decision.
